El Frente de Todos tiene los votos necesarios para avanzar con la iniciativa del Gobierno. Juntos por Cambio no dará quórum pero bajará a dar el debate.
El oficialismo buscará este jueves dar el primer paso en el Senado para avanzar con el proyecto del Gobierno de “organización y competencia de la Justicia Federal con asiento en la Ciudad de Buenos Aires y en las provincias”. El Frente de Todos tiene el número suficiente para darle media sanción a la iniciativa, cuyo texto original recibió una serie de modificaciones luego de tres semanas de debate. En tanto, el interbloque opositor de Juntos por el Cambio que rechaza el proyecto, anticipó que no dará quórum para la sesión remota convocada para las 14 horas, aunque difícilmente logre obstaculizarla.
La bancada oficialista obtuvo el miércoles de la semana pasada el dictamen de mayoría en el plenario de las comisiones Asuntos Constitucionales y de Justicia y Asuntos Penales, luego de seis largas jornadas por donde desfilaron 50 especialistas con respaldos y cuestionamientos. Varias de las observaciones de los expositores, fueron tomadas en cuenta para las modificaciones que se introdujeron al texto original del proyecto.
Entre los ejes principales de la iniciativa figura la unificación de los fueros Criminal y Correccional Federal y el Penal Económico Nacional, que pasarán a denominarse fuero Penal Federal con asiento en la Ciudad Autónoma de Buenos Aires. A los 23 juzgados de este nuevo fuero se sumarán otros 23, totalizando 46, y a su vez se sumarán 5 tribunales orales a los 12 existentes actualmente entre ambos fueros.
Las causas en trámite conservarán a sus jueces naturales, y las que se inicien irán a los 23 nuevos juzgados, que serán cubiertos por subrogantes: la Cámara Nacional de Casación Criminal elaborará un listado y los candidatos serán votados con dos tercios en el Consejo de la Magistratura. Se desechó el sistema electrónico del sorteo de las causas, que se realizarán con un bolillero en forma manual y que serán grabados para darle mayor transparencia, al tiempo que podrán ser presenciados por los magistrados.
En la provincia de Buenos Aires se crearán 15 nuevos juzgados federales penales. Y otros 48 en el resto de las provincias. El dictamen impulsa la creación de Cámaras Federales de Apelaciones o Salas en las provincias de Catamarca, San Juan o Santiago del Estero, donde se modificó la idea de crear nuevos juzgados. Se crearán también nuevas Cámara de Apelaciones en Catamarca, San Luis, Formosa, San Juan, y Santiago del Estero compuesta por una Sala con tres vocales.
Entre las principales modificaciones que se le realizaron al texto original del Gobierno, está la decisión de dar marcha atrás en la unificación de los fueros Civil y Comercial y el Contencioso Administrativo, aunque se creará un tribunal específico para dirimir las dispuestas de competencia entre ambos. Además, se hizo lugar al planteo de los organismos de derechos humanos, de que las secretarías con competencia específica en el tema conserven la competencia exclusiva y que esta especialidad sea mantenida. Y se incorporará al régimen penal juvenil una competencia exclusiva.
También se incorporó la propuesta del senador oficialista Oscar Parrilli de modificar las “Reglas de Actuación” de los jueces. “Comunicar en forma inmediata al Consejo de la Magistratura cualquier intento de influencia en sus decisiones por parte de poderes políticos, económicos o mediáticos, miembros del Poder Judicial, Ejecutivo o Legislativo, amistades o grupos de presión de cualquier índole, y solicitar las medidas necesarias para su resguardo”, dice el inciso E del artículo 72. La incorporación de la palabra “mediáticos” desató la ira de JxC que lo consideró “un ataque a la libertad de expresión”. Para el FdT es «una medida de resguardo para la independencia de los magistrados».
Todo hace prever que será un debate caliente. También que el oficialismo no tendrá problemas numéricos para sortear este primer paso. Todas las fichas JxC están puestas en frenar el proyecto en la Cámara de Diputados, donde el oficialismo no tiene mayoría pero que ya trabaja en su propia estrategia para dar pelea.
